Payment
1. You may enjoy access to the content on our website www.tvbanywhere.com (“Website”), in the applications for certain mobile devices or smart televisions or other compatible devices (Internet connection required) currently named “TVBAnywhere+” (“App(s)”), TVB Anywhere Set-Top Box (“STB”) or TVB Anywhere Android TV Box (“TV Box”)( collectively referred to as the “Service”) offered by TVB Anywhere Limited (“we”, “our”, ”us” or “TVBAW”) through purchasing/subscribing to our respective Service.
2. Payment will be charged to your credit card or Direct-Carrier-Billing at confirmation of purchase/subscription. The price listed is a one-off and non-refundable payment. All prices listed are inclusive of all applicable taxes. Unless otherwise specified, payments must be settled in U.S. Dollars (USD). However, for specific countries or regions, namely Australia, Malaysia, Singapore, the Eurozone, and the United Kingdom, payments may also be made in Australian Dollars (AUD), Malaysian Ringgit (MYR), Singapore Dollars (SGD), Euros (EUR), or British Pounds (GBP) respectively. All prices in all other foreign currencies are displayed for reference only. The actual exchange rate will be determined by the credit card issuing bank or payment service provider at the time of transaction execution. Subscribers in Malaysia may choose to pay by Direct-Carrier Billing instead, which will be charged in Malaysian Ringgit (MYR). Payment is subject to the applicable terms and conditions of the relevant third party payment service provider (if any).
Delivery of the Android TV Box (if included in the purchase/subcription)
3. The delivery of the TV Box will be arranged by TVBAW, its approved distributors and/or logistics companies, subject to their relevant terms and conditions on delivery. Please contact the respective parties for details. To the extent permitted by law, TVBAW accepts no responsibility for any damage, loss or delay in the delivery of the TV Box.
4. Under normal circumstances, the TV Box will be delivered to the address submitted by you in around 7 to 10 working days from confirmation of purchase/subscription. The TV Box will be delivered once only. If the delivery fails because the submitted address is inaccurate, incomplete, or no one takes delivery thereat after reasonable efforts have been made, the TV Box may be returned (without any refund to you) and additional costs (including delivery and/or storage costs) may be charged to you for other attempt(s). Please note that you may be responsible for customs clearance, if applicable, and for paying any customs fees or import duties that may be imposed by your country/region's customs authorities.
Using our Service
5. You may start enjoying our Service upon activation of your subscription. Your subscription is activated immediately once your payment has been confirmed. You may log in to our Service using your registered email address / TVB Member ID. Subscription period starts to run upon activation of your subscription.
6. Our Service is provided by TVBAW subject to the terms and conditions in "Terms of Use" for details. Please visit Privacy Notice (EU & UK) and Privacy Policy for “Privacy” details. You may also contact Customer Service for details.
7. Our Service is only applicable to compatible devices and designated mobile operating systems. Internet connection is required.
(a) For App(s) users (excluding those subscribed in Macau), you may also enjoy the benefit of accessing our App(s) on dedicated smart televisions. A list of compatible devices can be found at https://staticweb.tvbanywhere.com/certified-android-TV-list.pdf . You may simultaneously access to our App(s), on a maximum of TWO (2) devices.
(b) For STB or TV Box users, HDMI connection to TV is required.
Automatic renewal (applicable for purchase/ subscription of the Website, App(s) or TV Box, but not STB)
8. Upon expiry of the original subscription period, your subscription may be renewed automatically. You may not receive a separate notice that your subscription is about to end or has ended, or your subscription will be or has been renewed.
(a) Subscription automatically renews at the prevailing price (“Subscription Amount”) and for the same duration period as the original subscription unless you cancel your subscription in the “Account Settings” section any time up to 24 hours (if subscribed via in-app) or 72 hours (if subscribed via the Website) before the end of the then-current subscription period. Please note that while some users may have initially received a discount, rebate, or other promotional offer when they first subscribed, the renewal subscription price may not include any such discounts, rebates, or promotional offers and may be the regular price. We reserve the right to change our pricing at our sole discretion and, in the event of a price change, we will notify you thirty (30) days in advance of the change by sending an email to the email address you have registered for your account. If you do not wish to accept a price change, you may cancel your subscription plans or Services in accordance with the instruction included in that email and these terms and conditions. If you do not cancel your subscription plans or Services after the price change takes effect and prior to the start of your new subscription periods, your subscription will be renewed at the price in effect at the time of the renewal, without any additional action by you, and you authorize us to charge your payment method for these amounts.
(b) The Subscription Amount will be deducted from your account within 24 hours (if subscribed via in-app) or 72 hours (if subscribed via the Website) before your then-current subscription is set to expire, unless you cancel your subscription in the “Account Settings” section any time up to 24 hours or 72 hours respectively before the end of the then-current subscription period. If you do not have sufficient funds, you authorize us to charge the Subscription Amount to the payment method you provide at the time you sign up for the subscription or to the payment method you provide in the “Account Settings” section (“Payment Method”). Your subscription may be terminated by TVBAW if you have insufficient funds and no Payment Method has been set for automatic renewal on the date a payment is due or if payment is unsuccessful for any other reason.
(c) You may cancel your subscription by clicking the ‘Cancel Subscription’ button in the “Account Settings” section any time up to 24 hours (if subscribed via in-app) or 72 hours (if subscribed via the Website) before the end of the then-current subscription period to avoid the renewal of your subscription and billing of the Subscription Amount. Uninstalling our App(s) does not automatically end your subscription. When you cancel your subscription, your then-current subscription will remain active and you may continue to enjoy our Service until it expires, at which point you will no longer be able to access the paid features of our Service.
Geographical locations
9. Our Service may be accessed and the Content may be viewed at geographical locations based on your subscription package.
(a) For App(s) users, global access (except Canada, Hong Kong, Mainland China, Macau and USA) or Macau access only (for users subscribed in Macau).
(b) For STB users, particular territory access (depending on your selected subscription plan, and excluding Canada (effective from 1 January 2024), Hong Kong, Mainland China, Taiwan, USA, Malaysia and Singapore).
(c) For TV Box users, you may enjoy the same content as App(s) users by subscribing to the App(s), as the purchase of the TV Box itself comes with no Content subscription.
(d) For Website users, you may enjoy the same content as App(s) users.
Available territories are subject to change from time to time without prior notice. The content that may be available to view will vary by geographical location and will change from time to time.
General
10. TVBAW reserves the right to change, replace or withdraw any program(s), channel(s), pack(s), and/or content(s) (whether advertised or not) at any time with or without notice. TVBAW accepts no liability for any such change, replacement or withdrawal.
11. TVBAW reserves the right to vary or amend these terms and conditions at any time without prior notice. In case of any dispute, TVBAW reserves the right of final determination.
12. These terms and conditions are governed by and construed in accordance with the laws of Hong Kong. You consent to the exclusive jurisdiction of the courts of Hong Kong in connection with any legal action that may arise in relation to your use of our Service and/or these terms and conditions, and we reserve the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country.
13. In the event of any inconsistency between this English version of these terms and conditions and any foreign language translation, the English version shall prevail.
